  PRESIDENT'S MESSAGE

Hello ACC Colorado Chapter Members,

Have I met you yet?  Have you met our Board Members or attended an event in 2019?  Connect with us on Facebook and LinkedIn to view and post ACC Colorado pictures and connect with other ACC Colorado Members.  If you know someone new to in-house, bring them to an ACC event for free!

The Board would love to get to know you and what you want to receive out of your ACC Membership.  Our Chapter is doing a lot of introspection this year.  ACC Colorado is nothing without active members. We recently completed our Board Retreat with participation and input from active non Board Members.  We will be developing a strategic plan to address the needs of our over 700 members.  Please send me your thoughts as to how we can better involve you, how we can create content and deliver programming that is relevant to your practice and what types of events you are likely to attend.

Five Topics Your Colorado Employee Handbook Should Address

Counsel and their human resource colleagues should be aware of Colorado and federal changes in employment laws that should be incorporated into their employee handbooks. Specifically, Senate Bill 19-188, the FAMLI Leave Act, is currently pending in the Colorado legislature. This bill, if enacted into law, would provide for up to 12 weeks of paid family medical leave for employees; Colo. Rev. Stat. § 8-2-109, provides current and former employees access to their personnel files; Colo. Rev. Stat. § 8-2-126 limits employers’ use of consumer credit information; Colo. Rev. Stat. § 8-2-127 prohibits employers from accessing employees’ personal electronic communication devices; and the U.S. Supreme Court decision in Epic Systems Corp. v. Lewis upheld the enforceability of arbitration agreements in actions brought under the National Labor Relations Act (NLRA), and as a result employers should consider referencing an arbitration agreement in their employee handbooks. Below, we summarize each of these topics.

The Art & Science of Mediation

Virtually every case will be mediated – either courts encourage “voluntary” mediation before trial or mediation is required as part of an arbitration agreement.  The speakers will take a deep dive into many of these factors, from selecting a mediator, preparing for mediation, and the opening session, to private meetings with the mediator and final negotiations, among others.
